1. Who you are contracting with
Energy Economics (the "Service") is provided by Simple Business Solutions ("we", "us", "our"). By using the Service, you are entering into an agreement with Simple Business Solutions on these Terms & Conditions ("Terms").
2. Acceptance
By creating an account or continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you confirm you have authority to bind that organization.
3. The Service
Energy Economics is a personal productivity and budgeting tool that helps you triage inputs, define a value hierarchy, and allocate time and money. Features may change over time.
4. Your account
You must provide accurate information, keep it up to date, and keep your credentials confidential. You are responsible for all activity under your account.
5. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- use the Service for unlawful purposes, fraud, or spam;
- infringe intellectual property or privacy rights of others;
- upload malware, probe, scan, or interfere with the security of the Service;
- scrape, reverse engineer, or circumvent technical limits;
- resell or redistribute the Service without our written permission.
6. Intellectual property
We retain all right, title, and interest in the Service, including software, design, and branding. You retain ownership of content you create in the Service, and grant us a limited license to host and process that content solely to provide the Service.
7. Payments, subscriptions, and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries related to billing and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms available at paddle.com/legal/checkout-buyer-terms and our Refund Policy.
Subscription plans renew automatically until cancelled. You can cancel at any time through the billing portal; cancellation takes effect at the end of your current billing period.
8. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. Upon termination, your right to use the Service ends; we may delete your data after a reasonable export window.
9. Service level and warranties
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
10. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where excluding it is not permitted by law.
11. Indemnity
You will indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
12. Changes to the Service or Terms
We may update the Service and these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Simple Business Solutions is established, without regard to conflict of law principles. Disputes will be resolved in the competent courts of that jurisdiction.
